While upper-level condos are typically exempt, most rental setups in this area do fall under the law - and most landlords don’t even realize it.

What the Law Says?

Under Montgomery County Code Chapter 29, landlords must:

  • Disclose the results of a radon test if conducted within the last 3 years

  • Provide this information before a lease is signed

  • Allow tenants to terminate the lease if they discover unsafe levels go unaddressed

| This applies to any tenant occupying a basement or ground-level space |

That means even if you’re renting to one person in your basement, you’re covered in this requirement.
